Please read these Terms of Service ("Terms") carefully before using the Avanta Pharma Group website (the "Site") operated by Avanta LLC, doing business as Avanta Pharma Group ("Avanta," "we," "us," or "our"). By accessing or using the Site in any manner, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must discontinue use of the Site immediately.

1. Acceptance of Terms

These Terms constitute a legally binding agreement between you and Avanta LLC. Your continued use of the Site following any posted modifications constitutes acceptance of those changes. We reserve the right to amend these Terms at any time without prior notice beyond updating the "Last updated" date above.

2. Medical Disclaimer

The information published on this Site is provided for general informational and educational purposes only. Nothing on this Site constitutes medical advice, diagnosis, or treatment. All medications, including GLP-1 compounded formulations, require a valid prescription issued by a licensed healthcare provider following an independent clinical evaluation of the individual patient.

Avanta Pharma Group is a 503a compounding pharmacy. We prepare medications pursuant to valid prescriptions issued by licensed prescribers and do not practice medicine or make clinical determinations. The decision to prescribe any medication rests solely with the qualified healthcare provider and their patient.

3. Prescription & Order Requirements

No medication may be dispensed by Avanta without a valid, patient-specific prescription from a licensed healthcare provider in compliance with applicable federal and state law. By submitting an inquiry or order through this Site, you represent and warrant that:

• You are a licensed healthcare provider or are acting on behalf of one;
• Any prescription submitted reflects a bona fide prescriber-patient relationship and a legitimate medical need;
• All patient information provided is accurate, complete, and current to the best of your knowledge.

Submitting an inquiry through this Site does not constitute a confirmed order, a prescription, or the establishment of a pharmacist-patient relationship.

4. Assumption of Risk

All medications carry potential risks, side effects, and contraindications. GLP-1 receptor agonists and other compounded medications dispensed by Avanta may cause adverse reactions, including but not limited to nausea, vomiting, gastrointestinal discomfort, and more serious systemic effects in susceptible individuals. By using this Site and engaging with our services, you acknowledge that:

• The prescribing provider is solely responsible for assessing the suitability of any medication for their patient;
• Avanta makes no guarantees, express or implied, regarding therapeutic outcomes or the absence of adverse events;
• Patients must be informed of all material risks associated with their prescribed treatment before use.

5. No Returns: All Sales Final

Due to the nature of compounded pharmaceutical products and applicable state and federal regulations governing the handling of prescription medications, all sales are final once a medication has been dispensed and/or shipped. Compounded medications cannot be legally accepted for return, restocking, or reuse once they have left our facility.

In the event of a verified dispensing error or confirmed product defect attributable to Avanta, please contact us immediately at info@avantapharmagroup.com. Avanta will investigate and, where appropriate, provide a replacement or credit at its sole discretion in accordance with applicable law.

6. User Responsibilities

By using this Site and our services, you agree to:

• Provide accurate, truthful, and complete information in all forms, intake documents, and communications with Avanta;
• Not submit false, misleading, or fraudulent prescriptions or patient information;
• Not resell, redistribute, or transfer dispensed medications to any third party, as doing so may constitute a violation of federal and state law;
• Comply with all applicable federal, state, and local laws and regulations governing the prescribing, dispensing, and administration of pharmaceutical products;
• Promptly notify Avanta of any change in patient information that may affect the safety or appropriateness of a previously filled prescription.

7. Intellectual Property

The Avanta name, logo, trade dress, and all content on the Site, including text, graphics, photographs, and software, are the exclusive property of Avanta LLC or its licensors and are protected under applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of any Site content without prior written permission from Avanta LLC.

8. Disclaimers

The Site and all content are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. Avanta does not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.

9. Limitation of Liability

To the fullest extent permitted by applicable law, Avanta LLC, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of revenue, data, or goodwill, arising out of or related to your use of the Site or our services, even if advised of the possibility of such damages. Our total aggregate liability for any claim shall not exceed the amount paid by you to Avanta in the thirty (30) days preceding the event giving rise to the claim.

10. Governing Law & Dispute Resolution

These Terms of Service, and any disputes arising out of or related to them, shall be governed by and construed in accordance with the laws of the State of Alabama, without regard to its conflict of law principles. Any legal suit, action, or proceeding arising under or related to these Terms shall be instituted exclusively in the state or federal courts located in Baldwin County, Alabama. You hereby irrevocably consent to the exclusive personal jurisdiction and venue of such courts.

11. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
